The state would likely require a sedimentation control plan before the site is repaired, said Janet Boyer, regional engineer with the N.C. Division of Land Resources.
That's because Maggie Valley, which has jurisdiction in the area, doesn't have a slope development law stronger than the state building codes for retaining walls.
That law would require a soil compaction test to show that the base of the wall was setting on what engineers call native ground to make sure it's not being built on potentially unstable fill.
The park in 2007 didn't have a county- or city- issued building permit for the wall system. It's unclear whether one would have been required, or whether it would have mattered.
The rules for building a retaining wall whether at the coast or holding back 20,000 tons of earth on a mountaintop are the same statewide.
What's known about that development activity is the park in 2007 hired a contractor to build a geo-grid system of terraced retaining walls in front of an older timber-built wall that was failing.
